Filing Requirements for Montenegro

Requirements for Validation of trademark rights for which the deadline was 16 December 2011.

· Applicant's name and address

· Validity certificate issued by the Serbian IP Office attesting validity of trademark registration in Serbia on May 28, 2008.

· Power of Attorney simply signed by the applicant

National patent application

· Applicant's name andaddress

· Inventor’s name and addressor indication that inventor does not want to be mentioned in the application,in which case a statement by the inventor is needed.

· Applicant's statement onlegal grounds, in respect of inventor, to file application (employment,assignment of rights,...)

· Description and claims in Montenegrin/Serbian Latinic.

· Abstract can have a maximumof 150 words and one drawing (if such)

· One set of formal drawings(A4)

· Priority application data,if priority is claimed (application number, date and country)

· Power of Attorney thatshould be simply signed by the applicant

Extension of European Patent, in Monenegro, as designated for extension/ validation

· Applicant's name and address

· A copy of publication of granted EP

· Translation of description and claims of published EP into Montenegrin/ Serbian Latinic

· Power of Attorney simply signed by the applicant

Entering National Phase for PCT application, in Serbia, as designated country

· Applicant's name and address

· Inventor’s name and address or indication that inventor does not want to be mentioned in application, in which case a statement by the inventor is needed.

· Applicant's statement on legal grounds, in respect of inventors, to file application (employment, assignment of rights,...)

· A copy of PCT request

  • International Preliminary Examination Report translated into Montenegrin/ Serbian Latin alphabet
  • Description, specification and claims of international application translated into Serbian
  • Power of Attorney that should be simply signed by the applicant

Trademarks /New applications

· Applicant's name and address

· Denomination of a word, mark or one representation of device mark (in color if color is claimed)

· List of goods and/or services

· Priority application data, if priority is claimed (number, date and country)

· Power of Attorney simply signed by the applicant

Design

· Applicant's name and address

· Author’s name and address or indication that author does not want to be mentioned in the application. In such case author's statement that he does not want to be mentioned as an author is needed.

· Title of the design

· One set of photographs or formal drawings (A4 in a perspective view)

· Priority application data, if priority is claimed

· Power of Attorney simply signed by the applicant.

Remarks: The mentioned documents are minimal requirements. All required documents could be provided by electronic mail while originals may be filed subsequently with additional cost of Euro 1,00 only. Submission of documents in electronic format, is providing expeditious publication and examination. The working hours of the Mail Room of the Montenegro IP Office are from 8 a.m until 2 p.m. local time.
